In November 2023, Emotional Perception AI paved the way for AI innovation in the UK by securing a landmark ruling in the High Court, which opened the doors for artificial intelligence entrepreneurs and investors seeking patent protection in the UK.
The case centred on a technique that trains an ANN to perceive content in a way similar to human attitudes and mental interpretation. The innovation focuses on closing the semantic gap, which is the difference between reality and what the ANN suggests reality to be. Closing the semantic gap has often been described as the holy grail in AI technology.
On 11 February 2026, the UK Supreme Court issued its decision in a landmark ruling on patent protection for AI and computing technologies. Emotional Perception AI Ltd won a favourable ruling which has reinforced confidence in the UK as a hub of AI and computing innovation, and reflects the stated position of successive UK governments to position the country as a leader in these technologies. The UK digital economy already generates around £227 billion to £286 billion in activity, supporting roughly 2.6 million to 2.9 million jobs, or one in every 13.
At the heart of this David and Goliath case was whether artificial neural networks, a core component of AI systems, can be considered patentable inventions under UK law. The objective of the EPAI invention is a concept known as AI vector search and, more specifically, achieving the holy grail of AI technology: closing the semantic gap between the output of an ANN and how people actually interpret data and think.
The application of the EPAI technology is, in essence, an improved recommendation or search engine within a better system, so it has implications for internet searching and the fast identification of relevant content, whether that is a music track, a film or an effective medical treatment regime.
